These Terms of Service govern your access to and use of the GachaData website, interactive tools and JSON API (together, the “Service”). By using the Service you agree to these Terms; if you do not agree, please do not use the Service.

1. What GachaData is

GachaData is an independent, fan-made database, tool suite and JSON API for gacha video games. We compile and present game data — such as character stats, skills, recruitment rates and related datasets — and provide interactive tools built on that data. GachaData is an unofficial reference resource created by players, for players.

2. No affiliation; third-party intellectual property

GachaData is not affiliated with, endorsed by, sponsored by, or connected to any game developer or publisher. All game titles, characters, artwork, names, logos, audio and other game content, together with all related trademarks and copyrights, are the property of their respective owners. Such material is referenced and displayed solely to identify, document and describe each game for the informational benefit of players. We claim no ownership of it.

The original elements of the Service that we create — including the website design and source code, the selection, organisation and normalisation of data, our interactive tools, and this text — are owned by GachaData. You may not copy, resell or redistribute them except as expressly permitted in these Terms or the API section below.

3. Acceptable use

You agree not to: (a) use the Service in violation of any law; (b) represent the Service, or any data from it, as official or as endorsed by a rights holder; (c) access the Service in a way that disrupts it or that circumvents rate limits or security measures; (d) scrape, resell or redistribute our compiled data or tools except as permitted for the API; (e) attempt to gain unauthorised access to any part of the Service; or (f) use the Service to infringe the rights of others.

4. The GachaData API

We offer a read-only JSON API. Every request must include a valid access token, sent in the X-API-Key header. Tokens come in two tiers. A free token is issued to an email address (one token per email, subject to per-address and per-network limits that prevent abuse), is rate-limited with a daily quota, delivers data on a delay (Pro receives new games and patches day-one), gates the history and snapshot endpoints, and is intended for evaluation and light personal, non-commercial use with attribution to GachaData; running a bot, application or production service on the API requires Pro. A Pro token, available through our Patreon, removes the rate limit and endpoint gating and may be used in community projects, bots, sites and apps. By using the API you agree to: (a) attribute GachaData as the source wherever you display data obtained from it; (b) keep your token confidential and not share, resell or transfer it; (c) stay within the limits that apply to your tier and not attempt to circumvent them, including by registering multiple free tokens to evade rate limits; and (d) not present the data as official or as your own. The email you give to obtain a free token is handled as described in our Privacy Policy. Pro access is provided and billed through a third-party platform (Patreon) and is also subject to that platform’s terms. We may change, limit, deprecate or discontinue the API, any endpoint, any tier or any token at any time, and we provide no service-level guarantee.

5. No warranty

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. Game data changes frequently and may be incomplete, out of date or inaccurate. The Service is unofficial and should not be relied upon for any decision with material consequences. You use it at your own risk.

6. Limitation of liability

To the maximum extent permitted by law, GachaData and the individuals who operate it will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or relating to your use of, or inability to use, the Service.

7. Intellectual-property complaints & takedown

We respect the rights of content owners. If you are a rights holder, or an authorised agent, and believe that material on GachaData infringes your rights, please contact us at contact@gacha-data.com and include: the work concerned, the specific URL(s) at issue, a statement of your relationship to the rights, and your contact details. We will review promptly and will remove or disable access to material that we determine, in good faith, infringes valid rights.

8. Third-party links and advertising

The Service may contain links to third-party websites and may display third-party advertising. We are not responsible for the content, products or practices of third parties. See our Privacy Policy for how advertising and analytics operate.

9. Changes

We may modify the Service or these Terms at any time. Changes take effect when posted, with an updated “Last updated” date. Your continued use of the Service after changes are posted means you accept them.

10. General

A governing law and forum for these Terms have not yet been designated. Until they are, these Terms should be read as a statement of how the Service is offered and what is asked of you when you use it, and nothing here limits any right you have under the mandatory law of your own country of residence.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
